Terms of Service for Creators

Welcome to EDEN’s Immersive Music Cinema Player! These Terms of Service govern your use of EDEN as a creator. By creating an account, uploading content, purchasing services, or using our platform in any way, you agree to these terms. Please read them carefully.

1. Acceptance

 

By creating an account, uploading or streaming content, purchasing from us, or otherwise using EDEN’s services, you agree to this Agreement and consent to contract with us electronically. If you represent an entity, you must have the authority to bind it to this Agreement. In such cases, “you” refers to both the entity and any individual authorized to access the account. We may update this Agreement periodically. If you continue to use our Services after we post changes, you accept the revised Agreement. This Agreement includes our Privacy Policy and additional addenda specified in Section 12 below. Please review our Privacy Policy to understand how we collect, use, and protect your information.

2. Our Services

​

Service License: Subject to these terms, we grant you access to EDEN’s services, including the ability to:

• Stream and upload content you have the rights to distribute;

• Embed our immersive media player on third-party websites; and

• Utilize available features according to your plan.​

​

Features: The services and features you can access depend on your subscription plan. We may modify features over time, but for paid accounts, we commit to providing core services— such as content hosting and streaming capabilities—throughout your current subscription period.

​

Bandwidth: Each plan includes a specified bandwidth limit. If you exceed this limit, we may , ask you to upgrade, and, in most cases, give your account up to 60 days of advance notice.

​

AI Tools and Content Creation: EDEN may provide tools incorporating artificial intelligence or content creation technologies for video, audio, or text. By using these tools, you agree to comply with our AI Tool Addendum.

​

Transactions: We may offer digital goods, and their purchase terms are governed by our Digital Goods Agreement.

​

Monetization: EDEN may allow you to earn revenue through content sales or other monetization features. By using these services, you agree to the Monetization Addendum.

​

Third-Party Services: EDEN may provide links to or integrate with third-party websites or services. Use of any third-party services is governed by the relevant third-party terms and our Third-Party Service Addendum

3. Accounts

​

Registration: You must create an account to access certain creator features, such as uploading and live streaming. By creating an account, you agree to receive notices from EDEN at the email address you provide. It is your responsibility to keep this email current and valid.

 

Organizational Accounts: Organizational users, such as businesses or government entities, must display their legal name in their public profile. If you represent a government entity in the U.S., the Government Entity Addendum applies.

 

Age Requirements: You must be at least 16 years old or the age of majority in your jurisdiction, whichever is greater, to create an account. For commercial use, you must be at least 18. Users under the applicable age may only use our Services under a parent or guardian’s account, with their permission and supervision.

 

Parents and Guardians: If you permit your child to use the Services through your account, you assume full responsibility for monitoring their activity. If you believe unauthorized access has occurred, please contact us immediately.

 

Team Members: Certain subscription plans allow you to add “team members” with individual login credentials. You are responsible for their actions and must monitor their access.

 

Account Security: You are responsible for all activity under your account. Please safeguard your credentials, log out when using shared devices, and notify us if you suspect unauthorized access.

4. Plans and Subscriptions

​

Subscription Plans: EDEN offers various subscription plans, including both free and paid options. Each plan provides different features, storage, and bandwidth. For details on each plan, please refer to our Subscription Plans page.

 

Billing and Payment: By signing up for a paid plan, you agree to pay the fees associated with it. We will charge you automatically based on your chosen payment method.

 

Plan Modifications: You may upgrade or downgrade your plan. Downgrades take effect at the end of the current billing cycle, while upgrades apply immediately.

 

Renewal and Cancellation: Paid plans renew automatically unless canceled. You may cancel anytime before the renewal date to avoid further charges.

Refund Policy: Except where required by law, payments are non-refundable after 60 days.

​

5. Content and License

​

Your Content: You retain ownership of any content you upload to EDEN. By uploading, you grant EDEN a worldwide, non-exclusive license to store, display, distribute, and stream your content as necessary to operate the platform.

 

Prohibited Content: You may not upload content that violates laws, infringes on intellectual property rights, or is defamatory, obscene, or otherwise objectionable. We reserve the right to remove prohibited content and terminate accounts that violate these guidelines.

 

Content Protection: EDEN employs various tools to protect and secure content, but we cannot guarantee complete protection against unauthorized access or distribution.

6. Acceptable Use  

 

You agree not to use EDEN’s Services to:

​

• Distribute harmful or malicious content;

• Infringe on the rights of others;

• Bypass EDEN’s security measures or manipulate content limits (e.g., bandwidth restrictions); or

• Engage in any illegal activities.

7. Intellectual Property

 

Our Content: EDEN retains all rights to its logos, trademarks, and proprietary content. Except as explicitly authorized, you may not use EDEN’s brand elements for commercial purposes without permission.

 

User Content: You may use other creators’ content only as allowed by applicable licenses.
 

8. Termination

 

EDEN reserves the right to suspend or terminate your account if you violate these Terms of Service or engage in activities harmful to the platform. Upon termination, you may lose access to your content and any data associated with your account.

9. Disclaimers

 

EDEN provides the Services on an “as-is” basis without warranties of any kind. We do not guarantee uninterrupted access or error-free functionality, nor do we guarantee the accuracy of content provided by other users.

10. Limitation of Liability

 

EDEN’s liability is limited to the maximum extent permitted by law. In no event will EDEN be liable for any indirect, incidental, or consequential damages resulting from your use of the Services.
 

11. Indemnification

 

You agree to indemnify EDEN against claims, damages, and expenses resulting from any thirdparty claims related to your content or misuse of the Services.
